For purposes of this Privacy Policy, “Partner Platform” means the third-party systems and service providers used to operate the Venom Partner Portal and Venom Partner Network, including ShoutOut.

This Privacy Policy applies to customers, website visitors, Creator applicants, Creator Test participants, Official Venom Creators, Venom Partners, affiliates, network participants, and other individuals who interact with Venom.

Collected directly from you and, when relevant, from service providers involved in your transaction.

To create and administer Partner accounts, determine network placement, generate referral tools and promotional codes, attribute sales, calculate commissions, administer network commissions, communicate with Partners, process payouts, monitor compliance, prevent fraud, and enforce Program terms.

Source of collection:

Collected directly from Partners, automatically through the Partner Portal and referral technologies, and from Shopify, ShoutOut, PayPal, referring Partners, customers, and other service providers involved in administering the Partner Network.

Personal Information collected may include:

• First and last name;
• Email address;
• Telephone number;
• Account identifiers and login credentials processed through the Partner Platform;
• PayPal email address;
• Business or organization information;
• Social-media handles;
• Referral links;
• Promotional codes;
• Referral-cookie information;
• Upline and Downline relationships;
• Network position;
• Partner account status;
• Leads and referral activity;
• Qualifying sales;
• Revenue attributed to the account;
• Direct and network commissions;
• Payout history;
• Refund, return, chargeback, and commission-adjustment information;
• Communications with Venom and other Partners;
• Compliance, warning, suspension, and termination records;
• Identity-verification information;
• Taxpayer identification and tax-reporting information when required; and
• Other information necessary to administer the Partner Network.

CREATOR PROGRAM INFORMATION

Purpose of collection:

To review Creator interest, administer Creator Tests, evaluate Creator applications, determine eligibility, manage Creator relationships, review promotional content, administer Creator benefits, and enforce Creator Program requirements.

Source of collection:

Collected directly from applicants and Creators, from publicly available creator profiles and business pages, from Creator-submitted materials, and from platforms or service providers used to administer the Creator Program.

Personal Information collected may include:

• Name and contact information;
• Shipping address;
• Barber or business information;
• Social-media usernames;
• Follower, view, and engagement information;
• Content style and audience information;
• Previous brand experience;
• Portfolio and booking-site information;
• Creator applications;
• Photographs and videos;
• Content submissions;
• Voice, image, and likeness;
• Reflections, testimonials, and feedback;
• Client images or recordings included in submitted content;
• Content-approval and usage-rights records;
• Creator performance and compliance information; and
• Other information voluntarily submitted for Creator consideration.

Creators are responsible for obtaining appropriate permission from identifiable clients or other individuals included in submitted content.

REFERRAL AND ATTRIBUTION INFORMATION

When a person interacts with a Venom Partner’s referral link or promotional code, we may collect and associate information needed to determine whether a later purchase qualifies for Partner attribution.

This information may include:

• The referring Partner’s account or referral identifier;
• The referral link or promotional code used;
• Date and time of interaction;
• IP address;
• Device and browser information;
• Cookie identifiers;
• Pages or products viewed;
• Purchase activity;
• Customer identity;
• Order status;
• Commissionable revenue;
• Customer association information; and
• Other information necessary to verify attribution and prevent fraud.

The current Partner Network configuration may use a referral-cookie period of up to three years.

After a Partner generates an approved qualifying customer sale, Venom may use lifetime customer association to help attribute future qualifying purchases from that customer to the original referring Partner.

Referral cookies and lifetime associations do not guarantee commission and may be affected by browser settings, deleted cookies, device changes, competing attribution, refunds, fraud, account status, technical limitations, and current Partner Network rules.

INFORMATION WE RECEIVE FROM OTHER SOURCES

We may receive Personal Information from:

• PayPal;
• Payment processors;
• Shipping and fulfillment providers;
• Fraud-prevention and security providers;

When a customer purchase is attributed to a Venom Partner, limited customer and transaction information may be made available to the referring Partner through a purchase notification, report, or Partner Dashboard.

Depending on the Partner Platform and account permissions, this information may include:

• Customer name;
• Sale attribution;
• Sale date or status;
• Commissionable revenue;
• Commission amount; and
• Related referral information.

Partners may also receive limited information about participants within their referral network, such as:

• Participant name;
• Network placement;
• Upline or Downline relationship;
• Account activity;
• Referral or sales performance; and
• Commission-related information.

Partners are prohibited from using this information for unrelated marketing, selling it, sharing it improperly, or contacting a customer unless they have an independent lawful basis and appropriate permission to do so.

LEGAL AND SAFETY DISCLOSURES

We may disclose Personal Information when reasonably necessary to:

• Comply with applicable laws and regulations;
• Respond to subpoenas, court orders, warrants, or lawful government requests;
• Enforce contracts and policies;

• Protect Venom, customers, Partners, Creators, or others;

BUSINESS TRANSFERS

We have enabled Shopify Network Intelligence. When this feature is enabled, Shopify may use information from your interactions with our Site together with information from your interactions with other Shopify merchants and with Shopify to provide enhanced services. These services may include improved personalization, analytics, fraud prevention, store performance, product functionality, and more relevant advertising.

Information about your activity on our Site may be shared with or processed by Shopify and other service providers, including providers located in countries other than your country of residence, in order to provide these services.

We may send Partners and Creators:

• Welcome communications;
• Purchase notifications;
• Commission reports;
• Payout notices;
• Compliance notices;
• Program updates;
• Policy changes;
• Creator approval or rejection notices;
• Content-approval communications;
• Promotional resources; and
• Other communications related to participation.

Certain operational communications are necessary to administer an account and may not be treated as optional marketing messages.

You may unsubscribe from optional marketing communications using the unsubscribe method provided in the message, where applicable.

PAYMENT AND PAYOUT INFORMATION

Customer payments are processed through authorized payment providers.

Partner commission payouts are currently intended to be administered through PayPal.

Partners must provide an accurate PayPal email address before receiving eligible payouts.

PayPal and other payment providers may collect and process information under their own privacy policies. Venom does not control PayPal’s independent verification, security, retention, or account-review practices.

TAX AND IDENTITY INFORMATION

When required for Partner payments, tax reporting, legal compliance, fraud prevention, or account verification, we may collect:

• Legal name;
• Business name;
• Address;
• Taxpayer identification number;
• Form W-9 information;
• Identity-verification documents; and
• Other legally required information.

We use this information only for legitimate payment, verification, accounting, tax, fraud-prevention, and legal purposes.

SENSITIVE PERSONAL INFORMATION

Certain information we collect or process, such as taxpayer identification numbers, account login information, payout information, and identity-verification documents, may be considered sensitive personal information under applicable law.

Termination of a Partner or Creator relationship does not necessarily result in immediate deletion. We may retain information needed to reconcile commissions, address chargebacks, maintain tax records, enforce agreements, preserve licensed-content records, and comply with law.

When Personal Information is no longer reasonably required, we may delete, anonymize, or securely dispose of it, subject to legal and technical limitations.

SECURITY

We use reasonable administrative, technical, and organizational safeguards designed to protect Personal Information against unauthorized access, loss, misuse, alteration, or disclosure.

No method of electronic transmission or storage is completely secure. We cannot guarantee absolute security.

You are responsible for maintaining the confidentiality of account credentials and for notifying Venom promptly if you believe your account has been accessed without authorization.

INTERNATIONAL PROCESSING

Venom is based in the United States.

Shopify, ShoutOut, PayPal, and other service providers may process or store Personal Information in the United States or other countries.

Privacy and data-protection laws in those locations may differ from the laws in your jurisdiction.

By interacting with Venom, your information may be transferred to and processed in countries other than your place of residence as permitted by applicable law.

MINORS

The Site and Venom Partner Network are not directed to individuals under eighteen years old.

Individuals must be at least eighteen years old to participate in the Venom Partner Network or enter into a Creator agreement unless Venom expressly permits otherwise in writing and applicable law allows it.

We do not knowingly collect Personal Information from children in violation of applicable law.

GLOBAL PRIVACY CONTROL AND DO NOT TRACK

Because there is no universally accepted standard for ordinary “Do Not Track” browser signals, the Site may not respond differently to all Do Not Track signals.

Automated records may be reviewed, corrected, reversed, or adjusted by Venom when errors, fraud, conflicting information, returns, chargebacks, or disputes are identified.

We do not intentionally rely solely on automated processing to make legally significant decisions without human review where applicable law requires human involvement.

THIRD-PARTY WEBSITES AND SERVICES

The Site, Partner Portal, emails, and promotional materials may contain links to third-party websites or services.

Venom is not responsible for the privacy, security, or content practices of independent third parties.
